There is no single price for eDiscovery

Asking how much eDiscovery costs is rather like asking how much litigation costs: the answer depends on the matter. A small dispute involving a few mailboxes can be modest. A multinational investigation involving hundreds of custodians, mobile devices, collaboration data, multiple languages and months of review can cost vastly more. The useful question is not “What is the standard price?” but “Which parts of this matter will create cost, and what can we do about them?”

The main cost categories

Most eDiscovery expenditure can be traced to people, data and time. Collection may require specialist labour and tools. Processing can be charged by volume or service. Hosting may accrue monthly. Review can consume substantial professional time. Project management, analytics, redaction, translation, production and expert work may add further costs.

Collection costs

Collection cost depends on the number and type of sources, geographic spread, access, technical difficulty and whether forensic acquisition is required. A targeted and well-informed collection strategy can reduce cost substantially, provided it remains appropriate to the evidential need.

Processing costs

Processing turns collected data into material suitable for search and review. Volume matters, but so do file types, archives, encrypted material, corrupt files, OCR requirements and unusual data. Early data assessment can reveal whether large volumes are duplicates, system files or obviously outside scope before they become expensive review material.

Hosting costs

Review platforms may charge for stored or hosted data, users, features or combinations of these. The longer a matter remains open, the more recurring charges can matter. Teams should know which datasets genuinely need to remain online and whether inactive material can be archived without creating operational risk.

Review: often the largest variable

Human review can be one of the largest cost components because small changes in document volume or review speed multiply across thousands of hours. Clear protocols, email threading, deduplication, analytics, TAR and sensible batching can reduce unnecessary reading. The objective should be fewer avoidable review decisions, not simply cheaper reviewers.

Privilege, redaction and specialist review

Privilege review can require experienced lawyers and careful quality control. Privacy, confidentiality, commercially sensitive material and redaction can add separate workstreams. Multilingual matters may require translation or native-language reviewers.

Production costs

Production may involve imaging, native-file handling, extracted text, metadata, load files, numbering, redactions, secure transfer and QC. Complex specifications or repeated rolling productions can increase effort. Agreeing formats and expectations early helps avoid expensive rework.

Data volume is not the whole story

Ten gigabytes of straightforward email may be easier than one gigabyte of unusual application data. Twenty cooperative custodians in one cloud environment may be easier than five custodians using different devices and messaging platforms. Complexity, accessibility and context can matter more than raw size.

A simple cost model

A practical estimate can be built as: source identification and collection + processing and data reduction + hosting duration + review population multiplied by expected review effort + specialist work + production + project management + contingency. The assumptions behind each component should be written down so the estimate can be revised intelligently.

How to control cost

Start with the issues and likely evidence. Preserve broadly enough to manage risk, then collect and process proportionately. Test search and analytics before committing large review teams. Use deduplication, threading and TAR where suitable. Track actual volumes and review rates. Challenge unnecessary hosting and repeated reprocessing. Make cost a design consideration from the beginning rather than a crisis at the end.

False economies

The cheapest immediate option can create a more expensive project. Poor collection may need to be repeated. Inadequate processing may hide exceptions. Weak review instructions create re-review. Skipping QC can lead to a defective production. Cost control should remove waste, not remove necessary safeguards.

Budget conversations with clients

Clients deserve ranges, assumptions and sensitivity analysis rather than false precision. Explain what would happen if data volume doubles, review speed falls or another custodian group is added. Transparent uncertainty is more useful than an impressive-looking number that has no resilience.

eDiscovery cost is largely a consequence of scope and workflow. Technology prices matter, but the biggest savings often come from better decisions: identifying the right sources, reducing unnecessary data, designing review intelligently and responding early when assumptions change.
